Please read these Terms of Service carefully before booking or using any services offered by Incredible Clicks. By making a booking or using our website, you agree to be bound by these terms.
1. Services
Incredible Clicks provides professional photography and videography services including, but not limited to, weddings, portraits, events, products, and behind-the-scenes coverage. The specific scope of services will be agreed upon at the time of booking.
2. Booking & Confirmation
- A booking is confirmed only upon receipt of the advance payment (as agreed) and a signed/verbal confirmation of the booking details.
- Dates are reserved on a first-come, first-served basis. We cannot hold a date without a confirmed advance payment.
- Any changes to the booking (date, venue, package) must be communicated at least 15 days in advance and are subject to availability.
3. Payment Terms
- An advance payment (typically 30–50% of the total package cost) is required to confirm the booking.
- The remaining balance is due on or before the day of the event/session, unless otherwise agreed in writing.
- All payments are non-refundable except as outlined in the Cancellation Policy below.
4. Cancellation Policy
- Cancellation by the client: Advance payments are non-refundable. If cancellation is made more than 30 days before the event, any additional payments beyond the advance may be refunded at our discretion.
- Cancellation by Incredible Clicks: In the unlikely event that we must cancel (e.g., due to a medical emergency), all payments received will be fully refunded, or we will make reasonable efforts to arrange an alternative photographer.
- Rescheduling is subject to availability and must be agreed in writing.
5. Delivery of Photos & Videos
- Edited photographs and/or videos will be delivered within the timeframe communicated at the time of booking (typically 4–8 weeks for weddings and 1–2 weeks for other sessions).
- Deliverables are provided in digital format via an online gallery or cloud link unless otherwise agreed.
- The number of edited images delivered will be as discussed at the time of booking. Not all images captured will be delivered.
- We retain raw/unedited files and are under no obligation to provide them.
6. Copyright & Usage Rights
- All photographs and videos produced by Incredible Clicks remain the intellectual property of Incredible Clicks.
- Upon full payment, you are granted a personal, non-exclusive licence to print and share the delivered images for personal, non-commercial use.
- You may not sell, license, or commercially exploit the images without our prior written consent.
- We reserve the right to use images from your session for our portfolio, website, social media, and marketing materials, unless you have notified us in writing that you do not consent to this.
7. Client Responsibilities
- You are responsible for ensuring adequate access, lighting conditions, and cooperation of guests/subjects during the session.
- You agree to provide accurate event details (timing, venue, schedule) and notify us promptly of any changes.
- Incredible Clicks is not liable for missed moments caused by circumstances beyond our control (delayed schedules, restricted access, uncooperative guests, etc.).
8. Limitation of Liability
- In the event of equipment failure, unforeseen circumstances, or other factors that affect image quality or quantity, our liability is limited to a refund of payments made.
- We are not liable for any indirect, incidental, or consequential losses arising from the use of our services.
- Digital files are provided as-is once the gallery link is shared. We strongly recommend downloading and backing up your files immediately upon receipt.
9. Force Majeure
Incredible Clicks shall not be held liable for failure to perform services due to circumstances beyond our reasonable control, including natural disasters, government-imposed restrictions, illness, or other force majeure events.
10. Governing Law
These Terms of Service are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in the applicable jurisdiction.
11. Changes to These Terms
We reserve the right to update these Terms of Service at any time. The "Last updated" date will reflect the latest revision. Continued use of our services constitutes acceptance of the updated terms.
